Can You Really Face Felony Charges Just for Asking Questions About How Elections Work?
James O’Keefe and Cam Higby walked into Minneapolis polling places on primary day dressed in a way that stood out. They asked election workers how Minnesota’s vouching system works.
A registered voter can apparently stand up for as many as eight other people who lack normal proof of residence and help them register and vote the same day. They gave real voters’ names while they asked those questions.
Then they left.
They never signed the required oath. They never completed any form that would actually get them a ballot. They never touched a ballot.
They never voted.
Hennepin County Attorney Mary Moriarty charged both of them with felonies for unlawful voting and identity theft anyway. The theory is that simply using someone else’s name while starting a conversation about getting a ballot counts as intentionally misrepresenting your identity in applying for a ballot.
Moriarty has acknowledged it is pretty clear the men did not intend to vote. That detail did not stop the charges.
Minnesota’s vouching rule has drawn scrutiny for years because it creates an obvious opening for abuse. A registered voter can vouch for multiple people without those people having to show standard identification at the moment of registration. Critics have long argued the system is too loose.
O’Keefe and Higby set out to document how the process actually works in practice and what election workers would say when pressed. The video they produced got millions of views. Instead of addressing the underlying rules that make the demonstration possible, the county attorney’s office treated the documentation itself as the crime.
This is the same state that saw the Feeding Our Future scandal, in which large sums of federal child nutrition money were allegedly stolen through a network of fraudulent claims. High-profile fraud cases have repeatedly surfaced in Minnesota in recent years.
Yet the response to two people who filmed themselves asking questions at polling places and then walked away without voting is felony charges. The prosecutor who brought those charges is a progressive former public defender whose office has often emphasized reform and reduced emphasis on traditional prosecution.
The priority here appears to be punishing the people who filmed the process rather than tightening the process they filmed.
Asking election workers how a publicly available voting rule works is not the same thing as casting a fraudulent ballot. Using a name briefly while posing a question is not the same thing as completing a registration and voting under that name. The men stopped short of every step that would have turned their visit into an actual vote.
Charging them with felonies for the conversation itself sends a clear message that documenting potential weaknesses in the system will be treated as a threat. Whether that message is about protecting election integrity or protecting the current rules from scrutiny is a question Minnesota voters can answer for themselves.
The case now sits in court.
O’Keefe and Higby say they were doing undercover journalism and never crossed the line into applying for a ballot. The county attorney says the line was crossed the moment false names were given in the context of seeking a ballot. The facts that are not disputed are simple.
No one voted.
No oath was signed.
No ballot was taken.
The rest is interpretation, and the interpretation chosen by the prosecutor treats questions as felonies. This is a political prosecution meant to protect the democrat fraud machine of Minnesota from prying eyes…nothing more.

Obama grew up on mud pies in Kenya. He wouldn’t know class if it slapped him in the face.
Just look at his presidential library. It looks like a giant concrete block. Ugliest damn thing I’ve ever seen.
And this guy wants to talk about cheesecake? He wouldn’t know a good cheesecake if it bit him in the ass.
Obama loves mud pies. He’s a mud pie guy.
