Judge Beverly Cannone denied (predictably) the Commonwealth's motion to exclude Dr. Marie Russell's expert opinion that the wounds on Ofc. John O'Keefe's right arm were caused by a dog, not a Lexus taillight. What shocks (and frightens) me is Judge Cannone's remark that it was a 'close question'.
It really wasn't.
Those who witnessed Special Assistant DA Henry B. Brennan's boorish performance during the Daubert-Lanigan hearing saw the age-old 'when did you stop beating your wife' cliché brought to new extremes by a prosecutor whose objectives are far removed from the interests of the public. Mr. Brennan contorted himself every which way trying to goad Dr. Russell into ratifying the Michael Proctor/Joseph Paul version of the events of January 29, 2022. Did you consider the angle of impact? The speed of the car? The 'debris field'?
It was nauseating.
There was no impact. The 'debris field' was a concoction that didn't exist until days later. For Judge Cannone to rule about a 'close question' based solely on Mr. Brennan's unverified say-so lessens the integrity of the proceeding and cheapens its value, in my opinion. The Court conflated the foundation upon which Dr. Russell's expertise is built with the weight that ought to be afforded her opinion. She then made a judgement call, balancing Dr. Russell's learned opinion against what appears to be nothing more than Mr. Brennan's hyperbolic interpretation of Tpr. Joseph Paul's talismanic visions. It was kind of embarrassing.
Needless to say, it's not supposed to work that way. The question is supposed to be whether Dr. Russell's training, expertise and experience meet the requirements of Mass. G. Evid. § 702 and Commonwealth v. Polk, not whether Mr. Brennan can accuse Dr. Russell of overlooking peculiar factual circumstances she'd have no reason to consider.
Perhaps the only thing Mr. Brennan didn't accuse Dr. Russell of overlooking was the effect of @DoctorTurtleboy. "But Turtleboy, Dr. Russell! A-ha! You didn't consider Turtleboy in forming your conclusions, did you!" I write that firmly tongue-in-cheek, yet some seem to think that's the *only* thing that matters.
Maybe next the Commonwealth will foist upon these proceedings the views of a 'professional dog bite wound identifier' it somehow conjures from the ether. I doubt such an individual exists except in Mr. Brennan's illusions. But to win the case, Mr. Brennan needs thoroughly persuasive testimony from someone who exceeds Dr. Russell's expertise. That person will have to convince all twelve jurors that no reasonable medical expert could possibly conclude that the wounds on Ofc. O'Keefe's arm were caused by a dog.
I don't think that's gonna happen.

Even if you think the #DelphiTrial verdict was just, we do not wanna live in a country in which people who are presumed innocent can be thrown in solitary confinement in a maximum security prison to await trial w zero criminal history.
What the State of Indiana did to #RichardAllen was wrong whether he is guilty or not, & it could have just as easily been YOU.
The next time, it could be YOU.

This will take some time to process, but this case changed me as a person. Whether you think Richard Allen is guilty or not, this sets a precedence for all of us, for our children and for our parents. If the jury can put away a man for the rest of his life based on the evidence presented in court, evidence kept out and the way the Judge handled the case, none of us are safe. This is way bigger than Richard Allen. All of us are potential Richard Allens. I will take this as a chance to make whatever little or big difference I can. Count me in.

Now the jurors will come home to their families.
They will sit down, and they will search for the news.
They will find a wall of information they did not expect.
Information Judge Gull denied them access to.
Keep that wall of information up. That they convicted a man on manufactured evidence.
Manufactured by the investigators lying in the probable cause affidavit.
Manufactured by the prosecution trying to hide exculpatory evidence.
Manufactured by Judge Gull for keeping him in solitary confinement, that drove Mr Allen to a psychosis.
Manufactured by Judge Gull for not allowing in 90% of the defences case.
Shame on them. Shame.

This is what an oligarchy looks like, not a constitutional democracy. When you jeopardize the security of all Americans to benefit one particularly well-heeled supporter, then you become a Russia look-alike and betray the people. independent.co.uk/news/world…

As a reminder, the only thing you are loyal to is the Constitution. Especially military

A distraught friend yesterday boiled it down perfectly:
"If we won, we'd be celebrating how many of them would get healthcare, education, or student loans canceled. But they won, and they're celebrating how many of us they get to kill."
Tells the whole story, doesn't it?

The single worst thing about Trump to me will always be how much he's changed people. I've watched friends and relatives become entirely new, worse people in the wake of his political rise. Like it's not merely that he's a terrible guy, it's that he's ruined people.

Really is a tough call.
On one hand - every Nobel prize winning economist is adamantly stating that Harris has a significantly better economic plan
But on the other hand - the dumbest people I’ve ever interacted with say Trump is a good businessman
Quite the dilemma
Convicted felon. He has convictions on his record..... the fact he was allowed to run, the fact he apparently is getting even MORE votes after a literal coup attempt..... what is this timeline anymore.....
