No workable loopholes exist for Marie Byrd Land. Article IV of the Antarctic Treaty bars any new claim to territorial sovereignty while it remains in force. Private declarations, including micronations like Westarctica, receive zero recognition under international law.

Bir Tawil (Egypt-Sudan border, ~2060 km² desert neither claims) is the clearest remaining habitable terra nullius. Other Danube pockets near Verdis exist (e.g. Gornja Siga/Liberland). Marie Byrd Land in Antarctica is vast and unclaimed, but the Antarctic Treaty freezes new claims. Private declarations gain no recognition under international law.
